Woodbridge Business Owner Sentenced for Defrauding Virginia Medicaid Program

(Alexandria, VA) – Annette Fleming-McClatchey, 47, of Woodbridge, Virginia, was sentenced today to 40 months in prison, followed by a term of three years supervised release. She was also ordered to pay $3,745,649 in restitution to the Virginia Department of Medical Assistance Services (“DMAS”). Fleming-McClatchey pled guilty on August 7, 2008 to a federal health care fraud charge in connection with a scheme to defraud the Virginia Medicaid program. Dana J. Boente, Acting United States Attorney for the Eastern District of Virginia, and Joseph Persichini, Jr., Assistant Director in Charge, Federal Bureau of Investigation, Washington Field Office, made the announcement after the sentencing by United States District Judge T.S. Ellis, III.

According to court documents, Fleming-McClatchey was the owner and operator of Medco, a medical supply business located in Woodbridge, Virginia. She billed Medicaid for medical equipment and supplies that were either never provided to Medicaid recipients or provided in smaller amounts than billed. From September 2003 through September 2007, Fleming-McClatchey submitted more than $6.2 million in false claims to DMAS, which administers Medicaid funds in Virginia. Medicaid’s total losses as a result of the scheme exceeded $3.7 million.

The Federal Bureau of Investigation and Virginia Office of the Attorney General investigated the case. Assistant United States Attorney Timothy D. Belevetz and Special Assistant United States Attorney Steven W. Grist prosecuted the case on behalf of the United States.
