Washington, D.C. - Jose Medina, a 46-year-old Detective with the Metropolitan Police Department in Washington, D.C., was indicted today by a Superior Court grand jury on one misdemeanor count of simple assault, U.S. Attorney Jeffrey A. Taylor announced.
The indictment arises from the defendant’s alleged unlawful use of force against a handcuffed arrestee inside the Third District Detectives’ Office on October 14, 2006. An arraignment has yet to be set by the court.
If convicted of the charge, the defendant faces a maximum penalty of 180 days and/or a fine of $1,000.
The case is being prosecuted by Assistant U.S. Attorney Ann Carroll from the U.S. Attorney's Office in the District of Columbia, with the assistance of the Metropolitan Police Department’s Force Investigation Team, the Federal Bureau of Investigation, and the U.S. Secret Service.
Charges set forth in an indictment are merely accusations and the defendant is presumed innocent until proven guilty.
